Brand Terms

1. Who these terms apply to
These Brand Terms apply when you register for or use OutLoud on behalf of a brand or organisation. They supplement our general Terms of Trust and Privacy Policy. If there is a conflict, these Brand Terms prevail for brand-specific matters.
2. Campaign briefs & scripts
- You must provide accurate campaign briefs, including deliverables, compensation type, and product or service details.
- Campaign scripts (manual or AI-generated) are creative guidance for engaged creators — review and approve all scripts before publishing campaigns.
- AI-generated scripts are drafting aids only. You are responsible for ensuring scripts are lawful, accurate, and suitable for your product.
- Scripts are revealed to creators only after both parties sign the collaboration agreement.
- Do not require creators to make false claims, omit required disclosures, or violate platform advertising rules.
3. Creator engagement & approvals
- Review pitches and accept or decline collaborations in good faith.
- Sign agreements promptly when accepting a creator, and honour payment and usage terms stated in the agreement.
- Review draft content within a reasonable timeframe and provide clear, actionable revision feedback when needed.
- Do not request unlimited revisions beyond what was agreed unless renegotiated with the creator.
4. Payment obligations
OutLoud does not hold campaign funds or act as escrow. You pay creators directly using the payment method shown on each invoice, according to the payment terms in your signed agreement. Invoices generated on the platform support record-keeping but do not guarantee payment processing by OutLoud.
- Pay agreed amounts on time. Late or missed payments may affect your reliability score and visibility to creators.
- Brand subscription fees (Starter, Growth, etc.) are processed separately via Paystack.
5. Content licensing
Usage rights for creator deliverables (organic reposts, paid ads, whitelisting, duration, exclusivity) must be specified in your on-platform agreement with each creator. OutLoud does not automatically grant your brand any licence beyond what you and the creator agree.
- Request only the usage rights you need and compensate creators fairly for extended usage.
- Do not use creator content outside agreed terms without written consent.
6. Team members & permissions
Brand team members act on behalf of your organisation. You are responsible for their conduct on the platform and for assigning appropriate roles (owner, admin, member) with correct permissions for campaigns, pitches, and draft review.
7. Advertising compliance
You must comply with applicable South African advertising and consumer protection law. Ensure campaigns require appropriate sponsorship disclosure (#ad, Paid Partnership labels) and that product claims are truthful and substantiated.
8. Reliability & ratings
Creators may rate your payout speed after completed campaigns. Reliability scores are indicative and based on platform activity. Repeated late payments or unfair treatment of creators may result in reduced matchmaking visibility or account action.
9. Suspension & contact
We may suspend or terminate brand accounts that breach these terms, post misleading campaigns, or harm creators or the platform. Questions: arnold@phakama.digital.
